1. Parties and Purpose

Elocos establishes this Privacy Policy to transparently inform Users of the website hosted at the following address: elocos.be (hereinafter the “Site“), on how personal data is collected and processed by Elocos.

The term “User” refers to any individual or entity who visits or interacts in any way with the Site.

In this regard, Elocos determines all the technical, legal, and organizational means and purposes for processing Users’ personal data. Elocos is committed to taking all necessary measures to ensure that personal data processing complies with the law of July 30, 2018, regarding the protection of individuals with regard to the processing of personal data (hereinafter, the “Law“) and the European Regulation of April 26, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter the “Regulation“).

Elocos is free to choose any individual or entity that processes Users’ personal data on its behalf (hereinafter the “Processor“). If applicable, Elocos is committed to selecting a Processor providing sufficient guarantees regarding the technical and organizational security measures for personal data processing, in accordance with the Law and the Regulation.

2. Processing of Personal Data

Using the Site by Users may result in the communication of personal data. The processing of this data by Elocos, in its capacity as Data Controller, or by service providers acting on behalf and for the account of Elocos, will be in accordance with the Law and the Regulation.

3. Purpose of Processing Personal Data

In accordance with Article 13 of the Regulation, the purposes of processing personal data are communicated to the User and are as follows:

4. Personal Data That May Be Processed

The User consents, upon visiting and using the Site, for Elocos to collect and process, according to the methods and principles described in this Privacy Policy, the following personal data:

5. Consent

By accessing and using the Site, the User declares that they have taken note and freely, specifically, informed, and unequivocally agreed to the processing of personal data concerning them. This agreement pertains to the content of this Privacy Policy.

Consent is given by the positive action of the User checking the box proposing the Privacy Policy via a hyperlink. This consent is a necessary condition to perform certain actions on the Site or to enable the User to enter into a contractual relationship with Elocos. Any contract binding Elocos and a User regarding the SEO services and goods offered on the Site is subject to the User’s acceptance of the Privacy Policy.

The User consents to the Data Controller processing and collecting, in accordance with the methods and principles outlined in this Privacy Policy, their personal data communicated on the Site or during the services offered by Elocos, for the purposes indicated above.

The User has the right to withdraw their consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent previously given.

6. Duration of Personal Data Retention

In accordance with Article 13 §2 of the Regulation and the Law, the Data Controller retains personal data only for the time reasonably necessary to achieve the purposes for which it is processed.

This duration is in all cases less than: 6 months

7. Recipients of Data and Disclosure to Third Parties

Personal data may be transmitted to Elocos’ employees, collaborators, processors, or suppliers who provide adequate data security guarantees and collaborate with Elocos in the marketing of products or the provision of services. They act under the direct authority of Elocos and are notably responsible for collecting, processing, or subcontracting these data.

In all cases, data recipients and those to whom this data has been disclosed comply with the content of this Privacy Policy. Elocos ensures that they will process this data solely for the intended purposes, discreetly, and securely.

In the event that data is disclosed to third parties for direct marketing or prospecting purposes, the User will be informed in advance so they can express their consent to the use of their personal data.

9. Users’ Rights

a. Right of Access

In accordance with Article 15 of the Regulation, Elocos guarantees the right of access to the User’s personal data. The User has the right to obtain access to their personal data and the following information:

  • the purposes of the processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly recipients established in third countries or international organizations;
  • where possible, the envisaged duration of data retention or, when not possible, the criteria used to determine this duration;
  • the existence of automated decision-making, including profiling, referred to in Article 22, paragraphs 1 and 4 of the Regulation, and, at least in such cases, useful information on the underlying logic, as well as the significance and envisaged consequences of such processing for the data subject

The Data Controller may charge a reasonable fee based on administrative costs for any additional copies requested by the User.

When the User makes this request electronically (e.g., via email), the information will be provided in a commonly used electronic format, unless the User requests otherwise.

A copy of the data will be provided to the User no later than one month after receipt of the request.

b. Right of Rectification

Elocos guarantees the right to rectification and erasure of personal data to the User.

In accordance with Article 16 of the Regulation, inaccurate, incorrect, or irrelevant data can be corrected or erased at any time. The User can make necessary changes themselves from their user account/other, unless such changes cannot be made autonomously, in which case the request can be made to Elocos.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom personal data has been disclosed of any rectification of personal data, unless such notification proves impossible or involves disproportionate effort. The Data Controller provides information about these recipients if the data subject requests it.

c. Right to Erasure

The User has the right to obtain the erasure of their personal data without undue delay in the cases listed in Article 17 of the Regulation.

When the Data Controller has made personal data public and is required to erase it under the previous paragraph, the Data Controller, taking into account available technology and the costs of implementation, takes reasonable steps, including technical measures, to inform other controllers processing such personal data that the data subject has requested erasure by these controllers of any links to such personal data, or any copies or reproductions of it.

The two preceding paragraphs do not apply where the processing is necessary:

  • for the exercise of the right to freedom of expression and information;
  • to comply with a legal obligation requiring processing under Union or Member State law to which the Data Controller is subject, or to perform a task carried out in the public interest or in the exercise of official authority vested in the Data Controller;
  • for the establishment, exercise, or defense of legal claims.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom personal data has been disclosed of any erasure of personal data or any restriction of processing, unless such notification proves impossible or involves disproportionate effort. The Data Controller provides information about these recipients if the data subject requests it.

d. Right to Restriction of Processing

The User has the right to obtain restriction of processing of their personal data in the cases listed in Article 19 of the Regulation.

In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom personal data has been disclosed of any restriction of processing, unless such notification proves impossible or involves disproportionate effort. The Data Controller provides information about these recipients if the data subject requests it.

e. Right to Data Portability

The User has the right to receive personal data concerning them, which they have provided to the Data Controller, in a structured, commonly used, and machine-readable format and has the right to transmit this data to another Data Controller without hindrance from the Data Controller to which the personal data have been provided, in the cases listed in Article 20 of the Regulation.

f. Right to Object

The User has the right to object to the processing of their personal data based on Article 6 (1)(e) or (f) of the Regulation, on grounds relating to their particular situation.

The Data Controller will cease processing unless they demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of legal claims.

When personal data are processed for direct marketing purposes, the User has the right to object at any time to the processing of personal data concerning them for such marketing, which includes profiling to the extent that it is related to such direct marketing.

If the User objects to processing for direct marketing purposes, the personal data will no longer be processed for such purposes.

g. Automated Individual Decision-Making

The User has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or significantly affects them in a similar way, except in the cases listed in Article 22 of the Regulation.

10. Security Measures

Elocos implements appropriate technical and organizational measures to ensure the confidentiality, integrity, availability, and resilience of personal data processing systems.

In the event of a data breach that affects personal data, Elocos will notify the User as soon as possible and will also report the breach to the competent supervisory authority if necessary.

11. Updates to the Privacy Policy

Elocos reserves the right to modify this Privacy Policy at any time. Users are encouraged to review it periodically to stay informed of any changes. Continued use of the Site after any changes constitutes acceptance of the revised Privacy Policy.
